WEB SITE TERMS AND CONDITIONS OF USE
Important Legal and Security Information
The following rules and regulations established by Limited Stores, LLC ("Limited Stores") govern use by Limited Stores' associates of the Self-Service web site (the "Site"). The information you provide to Limited Stores on this Site will be used by Limited Stores for human resources management, which includes benefits administration, recruiting, management oversight and analysis, and payroll administration.
As a part of our efforts to maintain security on the Site, Limited Stores:
· Has implemented and uses industry standard encryption intended to protect your web sessions and the information that you provide or receive once you log onto the Site.
· Has implemented firewalls that help protect against unauthorized access from the outside world.
· Has designated this Self-Service Site as Level 1, Privacy Restricted Confidential information, for which Limited Stores limits access to only those people with a need to know and maintains access control lists and security logs.
· Will maintain the information you provide to the Site consistent with the Limited Stores Information Security Policy.
· Has put systems in place to detect attempts at unauthorized access to the Site.
As an additional security measure, Limited Stores requires everyone using the Site to agree to be bound by the following terms and conditions of access and use ("User Agreement"), as they may be modified by Limited Stores at any time and posted on this Site. You understand that your right to use the Site is expressly limited by this User Agreement.
Use of the Site:
This Site is provided by Limited Stores to you solely for your use as an associate to update your personal and benefits information and access your compensation information and/or, where authorized, to access or update information about associates who report to you ("Permitted Purpose").
Use of this site and the information contained herein is subject to the following policies which at the time of your first entry to the Site you agreed it was your responsibility to read and comply with these policies and any revisions to these policies as a part of the User Agreement:
1. Our Handbook. You received a copy of Our Handbook when you commenced your employment. If you cannot locate your copy, you may request a copy of Our Handbook from your manager or you may contact "HR Delivers" at 1.888.888-8003, Monday - Friday, 8:30 AM - 6 PM Eastern Time for a copy.
2. The Information Security Policy. Once you have authenticated your identification and password and entered the Site, there is a link to the Information Security Policy (by first clicking on "My Job", then clicking on "Information Security Policy"). Or you may request a hard copy of the Information Security Policy by contacting "HR Delivers" at 1.888.888-8003, Monday - Friday, 8:30 AM - 6 PM Eastern Time.
You must enter your valid User ID and password ("Credentials") to gain entry to the Site. If you are not located at or connected through a home office location, this may require creation of a password on your first visit to the Site. You should create and use nontrivial passwords by combining letters, numbers and special characters. Passwords that are proper names, words visible on your desk and popular song/book/movie titles can easily be guessed and therefore should be avoided. Other examples of other weak passwords include: PASSWORD, PASSWORD1, PASSWOR3, 25MAY1966. It is recommended that whether you are using the Site through a home office connection or otherwise, you should change your password frequently. You should not disclose your Credentials to anyone. It is your responsibility to safeguard and protect your Credentials and to monitor all use of your Credentials for all purposes. You accept all responsibility for maintaining the security of your Credentials and for all utilization of the Site via your Credentials.
Notify "HR Delivers" at 1.888.888-8003, (Monday - Friday, 8:30 AM - 6 PM Eastern Time) immediately if you have lost your Credentials. If you believe that someone has used your Credentials to access your information on the Site, contact "HR Delivers" at 1.888.888-8003, Monday - Friday, 8:30 AM - 6 PM Eastern Time.
If you have accessed the Site through the internet, you are responsible for obtaining and maintaining any communications equipment necessary to connect to the Site and your own internet service provider, including modems, computer hardware and software and long distance or local telephone service. Any charges incurred for such equipment or access are your sole responsibility.
The trademarks, trade names and other material contained on the Site are the property of Limited Stores or its affiliates. The material contained on the Site may include confidential and/or proprietary information of Limited Stores and its affiliated companies which, as a compilation and as to its constituent parts, is commercially valuable. This material may not be used, duplicated, disclosed, distributed, modified or discussed in whole or in part for any purpose other than the legitimate business purposes of Limited Stores and its related business operations. Any breach of confidentiality or failure to comply with these restrictions may result in irreparable injury to the company and is grounds for disciplinary action up to and including termination of employment. This Site may contain links to sites that are not affiliated with Limited Stores and you should be aware that these linked sites may not implement the same privacy and security measures as those implemented on the Site; you should review the privacy and information security measures of the linked sites before providing any information on those sites. Limited Stores disclaims any responsibility for material contained on such linked sites.

You shall NOT do any of the following unless explicitly authorized by Limited Stores:
a) attempt to modify the Site unless explicitly authorized;
b) access any area on the Site other than information associated with your User I.D. and password;
c) provide information about yourself that is inaccurate, incomplete or untrue;
d) interfere with, restrict or inhibit any other user from the use and enjoyment of the Site;
e) decompile, disassemble, probe, or otherwise reverse engineer, or modify, translate, merge, or prepare derivative works of the Site;
f) impersonate any person or entity, including but not limited to, another Limited Stores associate, any director or officer of Limited Stores or falsely state or otherwise misrepresent your affiliation with a person or entity;
g) collect personal information about other users of the Site;
h) knowingly upload, copy, post, publish, transmit, reproduce, distribute or participate in the transfer or transmit any files that contain viruses, corrupted files, or any other similar software or programs or any software in violation of copyright law, or the applicable software license agreement;
i) jeopardize the operation of computer systems owned by Limited Stores;
j) upload, post, e-mail or otherwise transmit any advertising or promotional materials, including without limitation, "junk mail," "surveys," "spam," "chain letters," "pyramid schemes," or any other form of solicitation or unauthorized communication;
k) automate the process of obtaining, downloading, transferring or transmitting any information or any other content to or from the Site;
l) use the Site for any purpose that is unlawful, tortious, abusive, intrusive on another's privacy, harassing, libelous, defamatory, obscene or threatening.
Your breach of any of the above prohibitions is grounds for disciplinary action up to and including termination of employment. Further, if you access the Site or any portion of the Site without authorization, you understand that you will be prosecuted to the fullest extent of the law and may be subject to civil/criminal penalties.
Protection of Limited Stores' Confidential Information:
All information relating to Limited Stores and its brands, affiliates or associates which is communicated to, learned, developed or otherwise acquired by you when using the Site which is not generally known to the public (collectively, "Confidential Information"), shall be confidential. With the exception of information you provide to Limited Stores through the Site, you shall not, at any time, disclose, communicate or divulge or permit disclosure, communication or divulgence to another, or use for your own benefit (except for the Permitted Purposes) or the benefit of another, any such Confidential Information.
Monitoring by Limited Stores:
Limited Stores is entitled, but not obligated, to review or retain the information you provide to the Site. Limited Stores may monitor your use of the Site to evaluate the quality of service you receive, your compliance with the User Agreement, the security of the Site, or for other reasons. You agree that these monitoring activities will not entitle you to any cause of action or other right with respect to the manner in which Limited Stores monitors your use of the Site or enforces or fails to enforce the terms of the User Agreement.
Modification of the Site or User Agreement, Notices and Communications, Reliance on Information You Submit:
Limited Stores may elect to update, modify, change or terminate
all or any part of the functionality available through the Site, including
modification or termination of any services provided, including your ability to
access the Site, at any time in the future. In addition, Limited Stores may
modify this User Agreement, the Guide or the User's Guide to the Information
Security Policy from time to time by amendments or modifications provided at
this Site. Access to the Site after such modifications or amendments will
constitute acceptance of all such modifications or amendments. Limited Stores
is entitled to rely on the e-mail and/or the
Termination of Access to and Use of Site:
Limited Stores may, in its sole discretion, immediately, and without notice, revoke your access to the Site should your conduct fail to fully conform to any of the terms and conditions of this User Agreement. Further, your access to this Site begins with your employment by Limited Stores or your creation of your Credentials and ends no later than upon termination of your employment with Limited Stores. You agree that on termination of your rights to access, you will immediately cease accessing the Site. The provisions relating to limited authorization, trademarks, confidential information, modification of the Site or User Agreement, notices, monitoring of the Site, your prohibited conduct, disclaimer of warranty and, limitation of liability shall survive the revocation of your access to the Site.
After termination of employment with Limited Stores, all requests for information or questions should be directed to "HR Delivers" at 1.888.888-8003, Monday - Friday, 8:30 AM - 6 PM Eastern Time.
Disclaimer of Warranty:
Access to the Site and the Site is provided "AS IS" and "AS AVAILABLE" and without warranty of any kind, whether express or implied, INCLUDING BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, THE ABSENCE OF ANY ERRORS AND OMISSIONS ON THE SITE, OR STATUTORY OF ANY KIND. LIMITED STORES ALSO DISCLAIMS ANY RESPONSIBILITY FOR ANY DAMAGES YOU MAY SUFFER INCLUDING LOSS OF DATA, FOR ANY DELAYS, NONDELIVERIES, MISDELIVERIES, SERVICE INTERRUPTIONS, OR LIMITED STORES ERRORS OR OMISSIONS.
Limitation of Liability:
IN NO EVENT WILL LIMITED STORES BE LIABLE FOR ANY DAMAGES OF ANY KIND RELATING IN ANY WAY TO THE SITE OR FROM INTERRUPTION, SUSPENSION OR TERMINATION OF SERVICE OR YOUR ACCESS TO THE SITE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, THIS LIABILITY EXCLUSION APPLIES TO ALL DAMAGES, WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL AND UNDER ANY LEGAL THEORY, WHETHER IN CONTRACT, TORT, EQUITY OR AT LAW, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES. THIS LIABILITY EXCLUSION INCLUDES, WITHOUT LIMITATION, ANY AND ALL DAMAGES RESULTING FROM YOUR USE OR THE INABILITY TO USE THE SITE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
If you have already entered the Site, you previously agreed to be legally bound by the terms of this User Agreement through an electronic signature, which acknowledged that you read and understood this User Agreement. Neither the changes nor anything in the User Agreement constitute a contract of employment.
